After winning your eviction case, a Writ of Possession is how you legally remove the tenant.
What Is a Writ of Possession?
A Writ of Possession is a court order that authorizes the county constable to physically remove the tenant and their belongings from your property.
It is the final step in the Texas eviction process — the mechanism by which the court's judgment is actually enforced on the ground.
Without a Writ of Possession, you cannot forcibly remove a tenant even after winning your eviction case in court. Attempting to remove a tenant without it exposes you to legal liability.
When Can You File?
- →After the court enters a judgment in your favor.
- →You must wait 5 days after judgment — the appeal period must expire first.
- →If the tenant appeals and loses, the writ can be filed after the appeal ruling.
- →The writ must be requested within 90 days of the original judgment.

Certified Copy of the Judgment
A court-certified copy of the eviction judgment issued by the Justice of the Peace court.
Writ of Possession Application
The court-specific form requesting issuance of the writ. Available from your local JP court.
